U.S. Intracompany Transfer Visa

Expand Your Business to America with the L-1 Visa

The L-1 visa allows qualifying international companies to transfer eligible executives, managers and specialized knowledge employees to a related U.S. business entity.

Understanding L-1 Visa

Connect Your Global Company with the U.S. Market

The L-1 visa is a nonimmigrant visa category designed for qualifying multinational organizations that need to transfer certain employees from a foreign office to a related office in the United States.

It can support companies seeking to establish a new U.S. office, expand existing operations, or transfer experienced personnel within an established international business structure.

Key point: The U.S. and foreign companies must have a qualifying corporate relationship, such as parent, subsidiary, branch or affiliate. Simply owning two unrelated businesses does not automatically establish eligibility.
Two Main L-1 Categories

Choose the Appropriate L-1 Visa Category

The right classification depends on the employee's role, experience and the nature of the position in the United States.

Executive & Managerial Transfer

L-1A Visa

L-1A is designed for qualifying executives and managers transferring to a U.S. parent, subsidiary, branch or affiliate.

  • Executives directing the management of an organization or major component.
  • Managers supervising professional employees or managing an essential function.
  • Eligible executives or managers establishing a qualifying new U.S. office.
  • Potential pathway to explore EB-1C eligibility separately, if all requirements are met.
Specialized Knowledge Transfer

L-1B Visa

L-1B is for employees who possess specialized knowledge of the company's products, services, processes, systems or procedures.

  • Employees with qualifying specialized knowledge.
  • Knowledge relating to the company's products, services or operations.
  • Transfers to a qualifying related U.S. organization.
  • Must meet the relevant employment and role requirements.
Eligibility Requirements

Who May Qualify for an L-1 Visa?

Both the qualifying organization and the employee must meet the applicable L-1 requirements.

◇

Qualifying Company Relationship

The foreign and U.S. entities must have a qualifying parent, subsidiary, branch or affiliate relationship.

✓

One Year of Employment Abroad

Generally, the employee must have worked continuously for the qualifying organization abroad for at least one year within the three years preceding the relevant U.S. admission.

▦

Qualifying Position

The employee must be transferring to work in an executive, managerial or specialized knowledge capacity, as applicable.

⌂

Active Business Operations

The qualifying organization must meet the applicable requirements for doing business in the United States and abroad.

◎

Supporting Documentation

Corporate records, ownership documents, employment evidence, organizational charts and job descriptions may be needed.

✧

Temporary Employment

L-1 is a nonimmigrant classification for qualifying temporary employment in the United States.

New Office L-1

Establish a New Office in the United States

Qualifying foreign companies may explore an L-1 new office petition when establishing a related business operation in the United States.

A new office case requires careful preparation. The company must demonstrate that it has the appropriate business structure, premises, financial ability and a credible plan for developing the U.S. operation.

  • Evidence of the qualifying relationship between the entities.
  • Appropriate physical premises for the proposed U.S. operation.
  • Business plan and financial ability to commence operations.
  • Evidence supporting the proposed executive or managerial role, where applicable.
  • A credible plan to support the qualifying position within the initial one-year new-office period.
Important: A new office L-1A petition is generally approved for an initial period of up to one year. An extension requires evidence that the U.S. business has developed sufficiently to support the qualifying role.
L-1A vs L-1B

Understand the Key Differences

These classifications serve different business and employee needs. The correct category depends on the actual duties and qualifications.

Application Journey

How the L-1 Visa Process Works

A structured process helps the company and employee prepare the relevant evidence and understand each stage.

01

Initial Assessment

Review the employee's work history, proposed role and the relationship between the foreign and U.S. entities.

02

Corporate Documentation

Organize company ownership records, business operations evidence, financial documents and organizational information.

03

Petition Preparation

The qualifying U.S. employer prepares and files the appropriate petition with USCIS, generally using Form I-129.

04

Visa & Travel Processing

Where applicable, the employee completes consular visa processing or the relevant U.S. status procedure.

Every L-1 Case Is Different

Processing times, documentary requirements, eligibility and any additional review can vary. A petition approval does not itself guarantee visa issuance or admission to the United States.

Family Considerations

Bringing Eligible Family Members

An L-1 employee's qualifying spouse and unmarried children under 21 may be eligible for L-2 dependent status, subject to applicable requirements.

L-2 spouses may be employment-authorized incident to status under applicable rules. Individual documentation and status requirements still apply.

Planning tip: Include family circumstances in the initial assessment so that dependent applications and travel arrangements can be considered appropriately.
