EB-2 National Interest Waiver
Explore a U.S. employment-based immigration pathway for qualified professionals and individuals whose proposed work may serve the national interest of the United States.
What Is the EB-2 NIW Green Card Category?
The EB-2 National Interest Waiver is an employment-based immigrant category that may allow certain qualified professionals to request a waiver of the usual job-offer and labour-certification requirements.
EB-2 classification is generally available to individuals who qualify as members of professions holding an advanced degree or as persons of exceptional ability in the sciences, arts or business.
A person requesting a National Interest Waiver must also establish that their proposed endeavour meets the applicable national-interest criteria.
An eligible NIW applicant may file Form I-140 on their own behalf. USCIS reviews each petition individually based on the evidence submitted and applicable immigration rules.
Basic EB-2 Eligibility Categories
Applicants must first qualify for the underlying EB-2 classification. There are two principal routes to establish this initial eligibility.
Advanced Degree Professional
This route generally applies to professionals who hold an advanced degree or its foreign equivalent.
- A U.S. advanced degree or foreign equivalent.
- Alternatively, a bachelor's degree or foreign equivalent followed by at least five years of progressive post-baccalaureate experience in the specialty.
- Evidence connecting the education and experience to the relevant professional field.
Exceptional Ability
This route may apply to individuals who demonstrate expertise significantly above that ordinarily encountered in the sciences, arts or business.
- Evidence meeting at least three of the six regulatory criteria, or comparable evidence where permitted.
- Documentation of professional recognition, achievements or expertise.
- Review of the overall evidence to determine whether the exceptional-ability standard is met.
The Three-Prong NIW Test
Under the framework established in Matter of Dhanasar, USCIS considers three central questions when evaluating a National Interest Waiver request.
Substantial Merit & National Importance
Does the proposed endeavour have substantial merit and national importance? USCIS examines the specific work the applicant intends to pursue and its potential prospective impact.
Well Positioned to Advance the Endeavour
Does the applicant have the education, skills, knowledge, track record, plan and other resources demonstrating they are well positioned to advance the proposed work?
Benefit of Waiving the Job Offer
On balance, would it benefit the United States to waive the job-offer and permanent labour-certification requirements in the applicant's circumstances?
Evidence That May Support an EB-2 NIW Petition
A well-prepared petition should connect the applicant's background, professional record and future plans to the legal requirements.
The relevant evidence depends on the individual's circumstances and proposed endeavour.
Fields That May Be Relevant to an NIW Case
NIW cases can involve different professional and entrepreneurial fields. The field alone does not establish eligibility; the specific proposed endeavour and evidence matter.
Science & Research
Scientific research, advanced studies, laboratory work and research initiatives with potential wider impact.
Technology & Engineering
Technology development, engineering innovation, critical technologies and specialised technical projects.
Healthcare & Public Health
Medical research, healthcare innovation, public-health initiatives and other relevant professional endeavours.
Business & Entrepreneurship
Business ventures, entrepreneurial initiatives, economic development and projects with a clearly supported national-interest rationale.

Including Eligible Family Members
Certain qualifying family members may be eligible to accompany or follow to join the principal applicant in the employment-based immigration process.
In general, an eligible spouse and unmarried children under 21 may qualify for derivative immigrant classification, subject to applicable immigration requirements and individual circumstances.
Family eligibility, documentation and timing should be reviewed as part of the overall immigration plan.

EB-2 NIW Questions & Answers
Learn more about common questions concerning the EB-2 National Interest Waiver category.
Can I apply for EB-2 NIW without a U.S. job offer?
An eligible applicant may request a National Interest Waiver of the job-offer requirement and may self-petition. The applicant must still qualify for EB-2 classification and satisfy the NIW requirements.
Do I need an employer to sponsor my EB-2 NIW petition?
A qualifying NIW applicant may file Form I-140 on their own behalf. A sponsoring employer is generally not required for the NIW self-petition route.
Is a master's degree mandatory for EB-2 NIW?
Not necessarily. An applicant may qualify through an advanced degree or through a bachelor's degree or foreign equivalent followed by at least five years of progressive post-baccalaureate experience in the specialty. A separate exceptional-ability route may also be available.
Does having a PhD guarantee EB-2 NIW approval?
No. A PhD may be relevant to the advanced-degree requirement, but it does not automatically satisfy the NIW test. The proposed endeavour and all three NIW prongs must be established with appropriate evidence.
Can entrepreneurs apply for EB-2 NIW?
Entrepreneurs may be able to pursue this category if they first qualify for EB-2 classification and demonstrate that their specific proposed endeavour meets the NIW requirements.
Does I-140 approval automatically give me a Green Card?
No. An approved I-140 petition is not itself a Green Card. The applicant must complete the appropriate immigrant-visa or adjustment-of-status process when eligible and when a visa is available.
Can my spouse and children be included?
A qualifying spouse and unmarried children under 21 may generally be eligible for derivative classification, subject to applicable rules and individual circumstances.
How long does the EB-2 NIW process take?
Processing times can vary based on USCIS workload, filing type, requests for evidence, visa availability and individual circumstances. No fixed timeline can be guaranteed.
